The purpose of the CALIXYS Privacy Policy is to provide you with information on the conditions under which CALIXYS collects and processes your Personal Information. By accessing and using our websites and any of the CALIXYS Software, you agree to read this Privacy Policy, which may be modified or updated at any time without notice. Any modification will be posted on the Site and we advise you to consult it regularly.

I. Purposes of processing and nature of data collected

1.1. As part of its customer, prospect, candidate or supplier relations, Calixys collects and processes personal data necessary for its activity as a software publisher (customer follow-up, support, prospect management, candidate management, supplier management, etc.).

To do this, we refrain, with regard to the nominative information that you entrust to us, from any indirect collection, any diverted use, and in general, from any act likely to harm your private life or your reputation.

Calixys therefore ensures that it only collects data that is strictly necessary for the declared purpose of the various processes implemented by the company. When requesting contact, a demonstration, initiating our contractual relationship, using our Solutions, registering for an event or a newsletter, the following data is collected for the purposes of the services provided by the company:

  • Full name
  • Company
  • Job title
  • Telephone number
  • E-mail address
  • Postal address

1.2  We collect information relating to the contractual relationship we have with you: history, Tools subscribed to, billing and payment details, requests and incidents reported to the support service, etc.

1.3. Through (or via) certain cookies automatically placed on your terminal, or other cookies subject to your express consent, we collect certain Personal Data when you visit our Site (www.calixys.com) or our Customer relationship management platform: for example, the date, time and duration of your visit to our site, the path of your browsing, the type of operating system you use, etc.

A cookie is a small text file sent by the website visited by the User to his/her Internet browser or to the device used. Its purpose is to enable the site to function, to make browsing easier (remembering technical choices, past activity), to improve use of the site and the service and to gain a better understanding of Users’ experience. The maximum lifetime of a cookie is 13 months.

II. Use of your Personal Data

In general, we are only entitled to process your data if you give us your explicit authorisation to do so. Thereafter, if we have a contractual relationship, the processing will be legitimate and necessary in the context of the monitoring of this relationship, insofar as you will be party to or associated with the performance of the pre-contractual or contractual measures taken with us. The data we collect has a specific purpose and is not used for any other purpose. Our purposes are specific, legitimate, explicit and compatible with our missions, in this case our activity as a software publisher. All personal data provided by the Owner will be processed in accordance with the provisions in force in France, and with the relevant regulations laid down by the European Parliament, the European Council and all other competent authorities. We will not use personal data in a manner different from that stated in this Policy. In the event that we require personal data for other purposes, we will publish a new privacy notice with the new details of the process. Calixys uses the personal data that you entrust to it in order to :

  • To provide the contractual services requested.
  • Contact you following a request for a demonstration of our Solutions, a contact request or a request to download content.
  • Send you information if you expressly choose to receive it, until you object/unsubscribe.
  • Register you for an event and manage it.
  • Manage your subscription options for any of our publications.
  • Where appropriate, offer you additional or optional services until you object.

Calixys also processes your data to meet its legal or regulatory obligations, the purposes of which are to retain the data required to be able to meet legal obligations and to manage data communication requests from the authorised authorities.

III. Processing of Personal Data

CALIXYS collects and processes your personal data fairly and lawfully, and in accordance with the principles of the European Regulation 2016/679 of April 27, 2016 (GDPR). CALIXYS is responsible for processing your personal data within the meaning of the GDPR. You can exercise your rights with CALIXYS at the address dpo@calixys.com.

IV. Conservation of your Personal Data

4.1 Security

CALIXYS does everything in its power to prevent the loss, misappropriation, intrusion, unauthorised disclosure, alteration or destruction of the Personal Data that you communicate to us. For example :

  • The Data is stored on our own servers, or hosted with service providers whose level of protection in terms of security and respect for confidentiality have been checked beforehand.
  • CALIXYS employees are subject to an obligation of confidentiality and non-disclosure and have all signed a specific undertaking relating to the protection of Personal Data.
  • Access to your Data is governed by a strict access control policy, reserved for authorised persons, under defined conditions.
  • When we use service providers to process Personal Data, we have first checked that these service providers guarantee an equivalent level of protection in terms of security.

4.2 Duration

CALIXYS stores your Personal Data in accordance with the following legal and regulatory provisions:

  • We retain information relating to the management of the Customer account, orders, invoicing and payments 10 years after the end of the contract or the last contact from the inactive Customer.
  • We keep information relating to the creation and management of prospecting files 3 years after the last contact from the prospect.
  • We keep the Data of inactive Customers for the purposes of sending information on our commercial and marketing offers, for a period of 3 years after the end of the Commercial relationship.
  • We are obliged to retain for 1 year the following Personal Data resulting from the creation, modification or deletion of User Content: connection identification, identification given by the terminal, types of protocols, nature of the operation, date and time of the operation, identification used by the author of the operation.

When the retention of Data is no longer justified by the management of a Customer account, a legal obligation, commercial requirements, the establishment, exercise or defence of our legal rights, or when you request us to do so in application of one of your rights (Article VIII), we will delete your Data in a secure manner.

V. Access to your Personal Data

5.1. Access to your data by CALIXYS employees

Depending on the purposes defined in Article I, employees of CALIXYS’ customer, support, administrative, accounting, technical, marketing and sales departments are likely to have access to Personal Data. Access to your data is carried out on the basis of individual access authorisations, as specified in article 4.1.

5.2. Data transmission

CALIXYS may subcontract the following services:

  • Hosting.
  • Sending of postal or digital mail.
  • Customer relationship management.
  • Maintenance.
  • Technical developments.

In accordance with article 28 of the RGPD, access to your Data by our subcontractors is provided for and governed by a contract. The contract between us and our subcontractors lists the various regulatory obligations incumbent on the subcontractor with regard to the protection of Personal Data.

VI. Transfert of Personal Data

We keep your Personal Data within the European Union. If the data we collect is to be transferred to subcontractors located in other countries, we ensure beforehand that appropriate guarantees are in place to supervise any transfer of Personal Data (such as the European Commission’s Standard Contractual Clauses with additional security guarantees), in accordance with the GDPR and recommendations of the European Data Protection Committee. We may also provide User’s Personal Data, only if required by French law, or ordered by a French court.

VII. Communications from CALIXYS

7.1. We may send you emails to the email address associated with your Account for reasons relating to our commercial relationship, i.e. technical or security reasons, administrative reasons relating to your subscription to the Software, your participation in our events, or to inform you of changes to our service offering.

7.2. We may also send you communications (mainly emails) containing promotional and marketing offers under the conditions set out in article VIII. If you unsubscribe from these communications, you will nevertheless continue to receive the communications listed in article 7.1.

VIII. Exercise of Users' Rights

In accordance with the French “Informatique et Libertés” law and the European Regulation 2016/679 of 27 April 2016 (RGPD), in force on 25 May 2018, you have the following rights concerning processing:

  • Right of access and rectification.
  • Right to object.
  • Right to erasure.
  • Right to portability.
  • Right to limit processing.
  • Right to organise what happens to your digital data after your death.

You can :

  • Manage the receipt of promotional communications (not related to a transaction) by simply clicking on the “unsubscribe me” link at the bottom of emails sent by CALIXYS.

A third-party cookie is a cookie placed on your terminal by the server of a domain other than that of the Site. Third-party cookies are generally those used by web analysis services, various marketing tools, social networks or different advertising platforms (retargeting).

2. Purpose of cookies

Cookies necessary for the operation of the Calixys website. These cookies are essential to guarantee the functioning and optimisation of the Site. They enable you to use the main features of the Site and to secure your connection. The Site uses :

  • Polylang: to manage the multi-language version.
  • Axeptio: for third-party cookie consent.
  • Envato and Elementor Pro: for the layout and design of the website.
  • Yoast SEO: for the website’s natural referencing.

As these cookies are essential to the operation and browsing of the Website or to the use of a service at your request, they cannot be refused via the cookies banner on the Calixys Website. Cookies used to measure the audience and interactions on our site. These cookies enable us to monitor the Site’s audience in order to generate statistical data on the use made of it. They enable us to improve the performance of the Site and to offer you tailored content.

IV. Consent to the deposit of cookies

1. Calixys consent management platform
